These Terms of Use ("Terms") govern your use of Pitch Commit (the "Service") operated by JKW CONSULTING GROUP LLC ("we," "us," "our"). By using the Service, you agree to these Terms.

1. Eligibility

You must be at least 13 years old to use the Service. If you are 13–17, you represent you have permission from a parent/guardian to use the Service. We do not permit use by children under 13.

2. Account registration and security

You're responsible for:

• Providing accurate information
• Keeping your login credentials secure
• All activity under your account

We may suspend or terminate accounts used in violation of these Terms.

3. Subscriptions, billing, and cancellation

If the Service includes paid plans:

• Pricing and features are shown on our pricing page.
• Subscriptions renew automatically unless canceled before the renewal date.
• You can cancel at any time in your account settings or through the platform where you subscribed (e.g., App Store/Google Play, if applicable).
• Fees are non-refundable except where required by law or explicitly stated in a refund policy.

4. What the Service does (and does not do)

Pitch Commit provides tools to organize recruiting efforts (tracking, messaging templates, planning). We are not affiliated with the NCAA or any school/athletic program. We do not guarantee roster spots, scholarships, coach replies, or recruiting outcomes.

5. User content

You may upload or store content such as notes, school lists, links, messages, and profile information ("User Content").

• You retain ownership of your User Content. You grant us a limited, worldwide, non-exclusive license to host, store, reproduce, and display your User Content only as needed to operate and improve the Service.
• You are responsible for your User Content and represent you have the rights to share it.

6. Acceptable use

You agree not to:

• Violate laws or regulations
• Harass, threaten, impersonate, or invade privacy
• Upload malware or attempt to disrupt the Service
• Scrape or reverse engineer the Service (except where legally allowed)
• Use the Service to send spam or unsolicited messages
• Infringe intellectual property rights

We may remove content or restrict accounts that violate these rules.

7. Intellectual property

The Service, including software, design, branding, and templates (excluding User Content), is owned by JKW CONSULTING GROUP LLC and protected by applicable laws. You may not copy, modify, distribute, or create derivative works without permission.

8. Third-party services

The Service may integrate with or link to third-party services (video hosting, email providers, etc.). We are not responsible for third-party services and your use is subject to their terms.

9. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, JKW CONSULTING GROUP LLC WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM (OR $100 IF YOU HAVE NOT PAID ANYTHING), WHICHEVER IS GREATER.

11. Indemnification

You agree to indemnify and hold harmless JKW CONSULTING GROUP LLC from claims arising out of your use of the Service, your User Content, or your violation of these Terms.

12. Termination

You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms or if required for safety/security/legal reasons. Upon termination, your right to use the Service ends.

13. Governing law

These Terms are governed by the laws of Texas, without regard to conflict-of-law rules.

14. Changes to the Terms

We may update these Terms. We'll update the "Last Updated" date and may provide notice of material changes.
